Welcome to HeyRuby.tv. These Terms of Service ("Terms") govern your access to and use of Hey Ruby, including our website, mobile applications, content production tools, AI-assisted video generation features, marketplace, subscriptions, episode purchases, exports, and related services (collectively, the "Service"). The Service is operated by Real Games, Inc. ("Real Games," "we," "us," or "our").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You may use the Service only if you can form a binding contract with Real Games and are not prohibited from using the Service under applicable law. You must be at least 13 years old. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.
We may require additional eligibility for certain features, including selling content in the marketplace, receiving payments, or accessing advanced creation tools.
You may need an account to use certain features. We may support account creation through Google, Firebase Authentication, or other identity providers. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account unless the activity results from our failure to maintain reasonable security.
Hey Ruby is an AI-assisted content production platform that helps users create, customize, render, share, license, buy, and sell videos and related creative assets. The Service may include AI-assisted script, image, video, voice, music, subtitle, and editing workflows; conversational creation tools; rendering through third-party AI providers; subscriptions, episode purchases, or rendering slots; social sharing and export features; marketplace listings, licensing, and transactions; analytics and performance insights; and human or automated content review and moderation. We may add, remove, suspend, or modify features at any time.
The Service uses artificial intelligence systems, including third-party AI generation providers. AI outputs may be unpredictable, inaccurate, offensive, infringing, or unsuitable for your intended use. You are responsible for reviewing all content before publishing, exporting, selling, licensing, or otherwise using it. We do not guarantee that AI-generated content will be unique, copyrightable, free from third-party claims, commercially usable, or suitable for a specific purpose.
"User Content" means content you upload, submit, enter, create, generate, edit, publish, list, sell, license, or otherwise provide through the Service. This may include prompts, scripts, images, videos, audio, voice recordings, likenesses, titles, descriptions, metadata, marketplace listings, and generated outputs. You retain any rights you have in your User Content, subject to the licenses granted in these Terms.

To operate and improve the Service, you grant Real Games a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, modify, adapt, publish, display, perform, distribute, create derivative works from, analyze, and otherwise use your User Content for the following purposes:
This license lasts as long as needed to provide the Service and to honor marketplace, licensing, legal, security, backup, and recordkeeping obligations.
Platform content is owned and licensed, not publicly distributable. All episodes, video clips, short-form dramas, micro-series, trailers, thumbnails, audio tracks, scripts, and related materials made available through the Service ("Platform Content") are owned by Real Games, Inc. or licensed to Real Games by their respective rights holders. Platform Content is protected by copyright, trade secret, and other applicable intellectual property laws.
Access to Platform Content is granted to you solely under the limited, personal, non-transferable license described in your subscription plan or purchase. This license does not include:
Any Platform Content released, posted, distributed, or published outside the Service without written authorization from Real Games constitutes infringement of Real Games' rights (and, where applicable, the rights of third-party licensors) and may expose the responsible party to civil liability, including claims for damages, disgorgement of profits, injunctive relief, and attorneys' fees.
The Service operates significant technical infrastructure to deliver and protect content, enforce licensing boundaries, and prevent unauthorized distribution. The following conduct is strictly prohibited and may result in immediate account suspension, termination, referral to law enforcement, or civil legal action.
You may not, without the prior written consent of Real Games:
We actively monitor the Service to detect abuse. The Service collects and retains access logs, authentication events, streaming request patterns, API call sequences, session information, and device identifiers. We use automated and manual analysis to detect scraping, bulk downloading, credential sharing, circumvention attempts, and other violations of these Terms.
If we detect or reasonably suspect a violation of these Terms, we may take any of the following actions:
We do not need to identify specific harm or financial loss to pursue enforcement action. Unauthorized access to, or distribution of, Platform Content is a serious violation of these Terms and applicable law.
The Service may allow users to list, buy, sell, license, or transfer rights to videos, templates, prompts, creative assets, or related content. When you list content in the marketplace, you authorize Real Games to display, promote, distribute, license, sell, and otherwise make that content available according to the listing terms you select or the marketplace terms presented at the time of listing.
Marketplace transactions may include non-exclusive licenses, exclusive licenses, buy-out rights, limited-use licenses, commercial-use permissions, custom production rights, or other license types made available through the Service. Unless expressly stated otherwise in a transaction, buyers receive only the rights described in the applicable listing or checkout flow, and sellers retain all rights not expressly granted.
You are responsible for ensuring that marketplace content you list is lawful, properly owned or licensed, and safe for the rights you offer. Real Games may remove listings, suspend sales, reverse transactions, withhold payouts, or restrict accounts if we believe content violates these Terms, applicable law, marketplace rules, third-party rights, or platform safety standards.
Certain features may require payment, a subscription, HeyRuby Tickets, rendering slot, usage fee, or marketplace transaction fee. HeyRuby Tickets may be used to unlock coin-gated episodes or tip/support creators. Prices, billing periods, usage limits, renewal terms, access duration rules, and refund policies will be shown at purchase or within the Service. By purchasing a paid feature, you authorize us and our payment processors to charge the payment method you provide.
Subscriptions may renew automatically unless canceled before the renewal date. You can cancel through account settings, the app store, or the payment provider used for purchase, depending on how you subscribed. Rendering slots may be consumed when rendering, generating, exporting, upscaling, testing, or processing content. Failed or partially completed generations may still consume a paid generation slot if third-party provider needs are incurred, unless we state otherwise. We may change pricing or paid features prospectively and will provide reasonable notice where required by law.
If the Service allows creator payouts, creators must provide a valid PayPal email address and may be required to provide tax, identity, address, country, and compliance information before receiving funds. HeyRuby does not ask creators for bank-account details for launch payouts. Payouts may be processed by third-party payment providers whose terms may apply. We may deduct platform fees, transaction fees, payment processing fees, refunds, chargebacks, taxes, or other disclosed amounts. We may delay, withhold, or deny payouts if we reasonably believe there is fraud, abuse, rights infringement, illegal activity, violation of these Terms, or a payment dispute.

We may use human reviewers and automated systems to review, rate, filter, restrict, or remove content for quality, safety, legal, and policy reasons. We may take action on accounts or content that we reasonably believe violate these Terms or applicable law. We are not obligated to monitor all content, and review does not guarantee that content is lawful or suitable for your use.
The Service relies on and integrates with third-party providers, including AI generation engines, cloud infrastructure, identity providers, payment processors, and analytics tools. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services we do not control.
The Service, including its software, design, branding, and content we provide, is owned by Real Games or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in the Service. "Hey Ruby," "HeyRuby.tv," and related marks are trademarks of Real Games.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that content generated through the Service will meet your expectations.
To the maximum extent permitted by law, Real Games and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or content, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or one hundred United States dollars ($100 USD).
You agree to indemnify and hold harmless Real Games and its officers, directors, employees, and agents from claims, damages, liabilities, and expenses, including reasonable legal fees, arising out of your User Content, your use of or access to the Service, your marketplace activity, your violation of these Terms or applicable law, or your unauthorized access to or redistribution of Platform Content.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. Account termination does not waive Real Games' right to pursue civil or criminal remedies for conduct that occurred prior to termination. Certain provisions — including those on content ownership, no redistribution, prohibited conduct, monitoring and enforcement, intellectual property, disclaimers, limitation of liability, and indemnification — survive termination.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Except where prohibited by law, you agree that any dispute relating to the Service will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable rights you may have under applicable consumer protection laws.
If you believe that content on the Service infringes your copyright, please send a written notice to tv@realgames.ai with the following information: identification of the copyrighted work claimed to be infringed; identification of the material claimed to be infringing and enough information for us to locate it; your contact information; a statement of good-faith belief that the use is not authorized; a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and your electronic or physical signature. We may terminate access for repeat infringers.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as posting the updated Terms with a new effective date. Your continued use of the Service after changes take effect means you accept the updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect. These Terms, together with our Privacy Policy and any additional terms presented within the Service, constitute the entire agreement between you and Real Games regarding the Service.
