Music and Audio Content Policy

Hey Ruby respects the rights of musicians, songwriters, labels, publishers, and other rights holders. Users may upload only audio they own, created, or are licensed to use. We do not permit unauthorized copyrighted music, including short clips, background music, remixes, or altered tracks. If we receive a complaint or believe audio may infringe someone’s rights, we may remove, mute, block, or restrict the content or account.

1. Purpose

Hey Ruby allows users to upload, create, edit, and share video content. This Music and Audio Content Policy explains the rules that apply when users include music or other audio in content uploaded to or distributed through the Hey Ruby platform.

The purpose of this policy is to reduce copyright risk, respect the rights of creators and rights holders, and provide a clear framework for handling audio-related content.

2. Scope

This policy applies to all users, customers, testers, partners, contractors, and any other person or entity using Hey Ruby’s services to upload, generate, modify, publish, or distribute content containing audio.

For purposes of this policy, “audio” includes music, sound recordings, musical compositions, instrumentals, karaoke tracks, loops, samples, remixes, voice recordings, podcasts, spoken word recordings, background audio, live recordings containing music, and audio captured incidentally in a video.

3. User Responsibility

Users are solely responsible for ensuring that any audio included in content uploaded to Hey Ruby is lawful to use.

By uploading content containing audio, the user represents and warrants that at least one of the following is true:

  The user owns all necessary rights in the audio.

  The user has obtained all necessary licenses, permissions, consents, and clearances.
• •
  The audio comes from a source that expressly authorizes the user’s intended use.
• •
  The audio is in the public domain.
• •
  The audio is original and created entirely by the user without infringing any third-party rights.

Users must not upload content containing audio if they do not have the legal right to use it.

4. Prohibited Audio Content

Users may not upload, publish, or distribute content through Hey Ruby that includes any of the following:

  Copyrighted music or sound recordings without the necessary rights or permission.
• •
  Commercial music copied from streaming services, downloads, CDs, television, film, radio, social media, or other third-party sources without authorization.
• •
  Unauthorized samples, loops, stems, remixes, mashups, or altered versions of copyrighted works.
• •
  Audio that infringes any copyright, neighboring right, moral right, contractual right, or other intellectual property right.
• •
  Audio where the user falsely claims ownership, license, or permission.
• •
  Audio that has been modified, sped up, slowed down, pitch-shifted, filtered, distorted, clipped, or otherwise altered in an attempt to avoid detection or enforcement.

5. No Short-Clip Exception

Hey Ruby does not recognize any informal “15-second rule,” “30-second rule,” or similar claim as permission to use copyrighted music.

Using only a short portion of a song does not, by itself, make the use lawful. Users must still have all rights required for their use.

6. No Reliance on Attribution

Giving credit to an artist, songwriter, label, publisher, or other rights holder does not create permission to use copyrighted music. Attribution alone is not a substitute for a license or other valid legal right.

7. Background and Incidental Audio

If copyrighted music appears in the background of a video, including audio captured in a public place, store, event, car, home, office, or live environment, the user remains responsible for ensuring the upload is lawful.

Hey Ruby may remove, mute, restrict, or disable access to content containing background music or other incidental copyrighted audio, even if that audio was not intentionally added.

8. No Pre-Clearance Obligation

Hey Ruby does not undertake to review, pre-clear, license, or verify the legality of user-submitted audio before publication.

The absence of pre-screening, automated detection, warning messages, or enforcement action does not mean that audio is licensed, lawful, or approved by Hey Ruby.

9. Rights Documentation

Hey Ruby may, at any time and in its sole discretion, request proof that a user has the right to use audio contained in uploaded content. Acceptable proof may include:

  A license agreement.
• •
  Written permission from the rights holder.
• •
  A receipt and license terms from a stock music provider.
• •
  Documentation showing original ownership.
• •
  Any other evidence reasonably satisfactory to Hey Ruby.

If a user cannot provide adequate proof promptly upon request, Hey Ruby may remove, mute, block, suspend, or otherwise restrict the content or account.

10. Copyright Complaints and DMCA Compliance

Hey Ruby responds to copyright complaints in accordance with its DMCA Policy and other applicable procedures.

If Hey Ruby receives a facially valid copyright complaint, takedown notice, or other credible claim regarding audio in user content, Hey Ruby may, without prior notice to the user:

  Remove the content.

  Disable access to the content.
• •
  Mute or replace the audio.
• •
  Suspend related publishing or sharing features.
• •
  Place a warning or strike on the account.
• •
  Take any other action permitted by the Terms of Service or applicable law.

Users who believe content was removed in error must follow Hey Ruby’s counter-notification or dispute procedures, if available.

11. Repeat Infringer Policy

Hey Ruby may suspend, restrict, or terminate accounts of users who repeatedly upload content that infringes copyright or other intellectual property rights.

Hey Ruby reserves the right to determine, in its sole discretion, what constitutes a repeat infringement pattern, including based on:

  Multiple takedown notices.

  Repeated audio-related complaints.
• •
  Repeated inability to provide proof of rights.
• •
  Attempts to re-upload removed content.
• •
  Attempts to evade enforcement by editing or disguising audio.

12. Enforcement Rights

Because Hey Ruby is an early-stage platform and may not have automated audio-identification systems in place, Hey Ruby reserves the right to act conservatively when copyright risk appears to exist.

Hey Ruby may, in its sole discretion and without liability to the user:

  Remove or disable access to content.

  Mute audio tracks in whole or in part.
• •
  Block publication or sharing.
• •
  Request proof of rights.
• •
  Restrict account features.
• •
  Suspend or terminate accounts.
• •
  Cooperate with rights holders and legal authorities as required by law.

13. No Obligation to Obtain Licenses

Hey Ruby is not obligated to obtain licenses for music or audio selected by users, and Hey Ruby does not assume responsibility for paying royalties, sync fees, master use fees, public performance fees, or other amounts arising from unauthorized user uploads.

If Hey Ruby later chooses to provide a licensed music library or other audio tools, use of those tools will remain subject to separate license terms and product rules.

14. User Indemnification

To the fullest extent permitted by law, users are responsible for claims arising from the audio they upload or distribute through Hey Ruby. Users agree to indemnify, defend, and hold harmless Hey Ruby, its parent company, affiliates, officers, directors, employees, contractors, agents, successors, and assigns from and against any claims, losses, liabilities, damages, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  Uploaded audio content.

  Alleged infringement.
• •
  Breach of this policy.
• •
  Breach of the user’s representations and warranties.
• •
  Violation of any third-party rights.

15. Consequences of Violations

Violation of this policy may result in one or more of the following actions:

  Content removal.
• •
  Audio muting or replacement.
• •
  Warning or strike.
• •
  Temporary suspension.
• •
  Permanent account termination.
• •
  Legal escalation where appropriate.

16. Changes to This Policy

Hey Ruby may revise this Music and Audio Content Policy at any time. Updated versions become effective when posted, unless otherwise stated.
