Privacy Policy

This Privacy Policy explains how Real Games, Inc. ("Real Games," "we," "us," or "our") collects, uses, discloses, and protects information when you use HeyRuby.tv and Hey Ruby, including our website, mobile applications, content production tools, any marketplace features we may offer, and related services (collectively, the "Service").

This Privacy Policy is intended to help you understand our privacy practices. Your use of the Service is also subject to our Terms of Service.

By using the Service, you agree to this Privacy Policy.

1. Information We Collect

We collect the following categories of information:

  • Account information. When you sign up, we may collect your name, email address, profile photo, and authentication identifiers from providers such as Google or Firebase Authentication.
  • Content you provide. Prompts, scripts, images, videos, audio, voice recordings, titles, descriptions, and other content you create, upload, or generate, including marketplace listings if marketplace features are offered.
  • Transaction information. Purchases, subscriptions, HeyRuby Ticket grants and spends, episode unlocks, tips, marketplace activity, and limited billing details. Full payment card details are handled by Stripe, our payment processor, and are not stored by us.
  • Viewing activity. Episodes and series you watch, watch progress, items you add to My List, favorites, and reward or bonus claims, used to operate resume playback, personalization, and creator compensation.
  • Usage and device information. Pages viewed, features used, interactions, approximate location derived from IP address, device and browser type, identifiers, language preference, and log data. We use approximate location derived from your IP address to set default language and currency options for your session.
  • Analytics and engagement signals. Viewing patterns, attention and engagement metrics, and similar signals used to operate discovery, recommendations, and reporting features.
  • Creator information. If you are a creator, we collect the payment, tax, identity, address, and compliance information needed to pay you, some of which is collected and processed by Stripe.
  • Communications. Messages you send to support, feedback, and survey responses, and records of transactional emails we send to your account email address.

2. How We Use Information

We use information to:

  • Provide, operate, maintain, and improve the Service.
  • Render, process, store, and deliver content you create or transact.
  • Process payments and manage subscriptions, HeyRuby Ticket wallets, episode unlocks, creator tips, and creator payouts, and maintain related transaction records.
  • Personalize content, recommendations, discovery, and rankings, including remembering your watch progress and My List.
  • Provide the Service in your preferred language, including localized interfaces and machine-translated subtitles.
  • Perform content review, moderation, safety, and quality assurance.
  • Detect, prevent, and respond to fraud, abuse, and security incidents.
  • Monitor access patterns, session behavior, API call sequences, and streaming request logs to detect scraping, bulk downloading, automated access, stream ripping, credential sharing, circumvention of security controls, and other violations of our Terms of Service. Logs generated by this monitoring may be preserved and used as evidence in civil or criminal proceedings. See our Terms of Service, Section 9, for our full enforcement policy.
  • Communicate with you about the Service, including transactional emails about purchases, subscriptions, Ticket balances, and creator earnings, plus updates and support.
  • Comply with legal obligations and enforce our Terms.

3. Legal Bases for Processing (EEA and United Kingdom)

If you are in the European Economic Area or the United Kingdom, we process your personal data under the following legal bases:

  • Performance of a contract: to provide the Service, process purchases and subscriptions, manage Ticket balances, deliver content, and pay creators.
  • Legitimate interests: to secure the Service, prevent fraud and abuse, enforce our Terms, analyze and improve the Service, and promote our business, balanced against your rights and interests.
  • Consent: where required, for example for certain cookies, analytics, or marketing communications. You may withdraw consent at any time.
  • Legal obligation: to comply with tax, accounting, and other legal requirements.

4. AI Processing

The Service uses artificial intelligence technologies to help users create, generate, edit, process, moderate, recommend, and deliver content. To provide these features, we and our third-party AI service providers may process prompts, scripts, images, videos, audio, voice recordings, titles, descriptions, uploaded files, and other inputs or content you submit to the Service.

AI-generated outputs may be stored, reviewed, moderated, displayed, distributed, or otherwise used to operate, secure, and improve the Service, consistent with this Privacy Policy and our Terms of Service.

We may use information and content submitted to the Service to improve our products, safety systems, recommendations, moderation tools, and user experience. We do not use private, unpublished user content to train third-party foundation AI models unless we disclose that use or obtain consent where required by law.

Do not submit confidential, sensitive, personal, or third-party information unless you have the legal right to do so and are comfortable with that information being processed by AI systems and service providers.

5. How We Share Information

We may share information with:

  • Service providers. Providers that process information on our behalf, including Google Cloud and Firebase (hosting, authentication, storage, logging, and content delivery), Stripe (payment processing and creator payouts), Google Analytics (usage analytics), Postmark (transactional email delivery), machine-translation providers (subtitle and interface translation), AI generation engines, and support tools.
  • Advertising partners. We use the TikTok Pixel, an advertising measurement tool provided by TikTok, on the customer-facing pages of the Service. The TikTok Pixel collects information such as device and browser details, IP address, cookie and similar identifiers, and the pages you view, and shares that information with TikTok so we can measure the performance of our TikTok advertising campaigns, build ad audiences, and improve ad targeting. This may be considered "sharing" for cross-context behavioral advertising under some privacy laws, and you can opt out as described in Sections 6, 8, and 9.
  • Other users and the public. Content you publish, share, or make public, along with associated profile details you choose to display.
  • Buyers and sellers. If marketplace features are offered, information reasonably necessary to complete marketplace transactions and licensing.
  • Legal and safety. Authorities or third parties when required by law or to protect rights, safety, and the integrity of the Service.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets.

We do not sell your personal information for money. Some privacy laws, including the CCPA, define "sale" and "sharing" broadly, and our use of advertising tools such as the TikTok Pixel may be considered "sharing" of personal information for cross-context behavioral advertising under those definitions. Where those definitions apply, you have the right to opt out, and we honor opt-out requests and Global Privacy Control signals as described below.

6. Cookies, Analytics, and Similar Technologies

We use cookies, local storage, and similar technologies to keep you signed in, remember preferences such as your language, secure the Service, and measure usage. You can review and change your cookie choices at any time using the "Cookie Preferences" and "Do Not Sell or Share My Personal Information" controls in the site footer and in the cookie notice shown on your first visit. We run our own first-party measurement of which shows and episodes people watch, where visitors come from, and time on site so the catalog and the Service work; it uses a random identifier, never your name or email, it is never sold or shared with anyone, and when you opt out of non-essential cookies it stores nothing on your device (the identifier lives in memory for the current page only). We never sell your personal information. We use Google Analytics in our production environment to understand how the Service is used, including measurement of page views, feature usage, and purchase and subscription events; Google Analytics sets its own cookies and identifiers, which are subject to Google's privacy policy. Where required by law, we will request your consent before setting analytics cookies.

We also use the TikTok Pixel in our production environment to measure the effectiveness of our TikTok advertising campaigns and to support ad measurement, audience building, and ad targeting. The TikTok Pixel sets its own cookies and identifiers and shares information such as device details, IP address, and pages viewed with TikTok, subject to TikTok's privacy policy. Where required by law, we will request your consent before setting advertising cookies.

You can control cookies through your browser settings, though some features may not work properly without them. You can opt out of Google Analytics across websites by installing Google's browser opt-out add-on, available at tools.google.com/dlpage/gaoptout. You can limit how TikTok uses your information through the ad and privacy settings in your TikTok account, and you can opt out of our "sharing" of personal information for advertising by using cookie controls or by sending a Global Privacy Control (GPC) signal from your browser, which we honor as described in Section 8.

7. Data Retention

We retain information for as long as needed to provide the Service and for legitimate business and legal purposes, such as honoring marketplace and licensing obligations, maintaining accurate financial and creator-payout records, resolving disputes, maintaining security and backups, and complying with law. When information is no longer needed, we take reasonable steps to delete or anonymize it.

When you delete your account, we delete your profile and personal activity records, including favorites, watch history, unlocks, reward claims, Ticket transactions, and notifications, along with your authentication account, so that the email address can be used for a fresh signup. We may retain records that we are required or permitted to keep, such as financial transaction records, payout and tax records, and logs preserved for security, fraud, or legal reasons.

8. Your Choices and Rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to object to or restrict certain processing. You may also have the right to opt out of certain sharing or targeted advertising. You can manage much of your information in account settings, including deleting your account, and you can contact us at tv@realgames.ai to make a request. We will respond consistent with applicable law and may need to verify your identity.

We will not discriminate against you for exercising your privacy rights. Where the law allows, an authorized agent may make a request on your behalf with proof of authorization.

We honor Global Privacy Control (GPC) signals and other legally recognized universal opt-out preference signals sent by your browser or device as a request to opt out of any sale or sharing of personal information, to the extent required by applicable law.

9. California Privacy Disclosures (CCPA/CPRA)

This section applies to California residents and supplements the rest of this Privacy Policy.

Categories of personal information we collect: identifiers (such as name, email address, IP address, and account identifiers); commercial information (such as purchases, subscriptions, Ticket transactions, and tips); internet or other electronic network activity information (such as viewing history, usage logs, and interactions with the Service); approximate geolocation derived from IP address; audio or visual information you submit (such as uploaded video or voice recordings); professional information for creators (such as tax and payout details); and inferences used for recommendations and personalization.

Sources: we collect this information directly from you, from your devices, from identity providers you use to sign in, and from our payment processor.

Purposes: we use these categories for the business purposes described in Section 2, including providing the Service, processing payments, personalization, security, moderation, analytics, and legal compliance.

Disclosure: we disclose these categories to the service providers and other recipients described in Section 5 for business purposes. We do not sell personal information for money. Our use of the TikTok Pixel for advertising measurement and targeting may constitute "sharing" of identifiers and internet activity information for cross-context behavioral advertising as defined by the CCPA, and you have the right to opt out of that sharing at any time, as described below. We do not knowingly collect, sell, or share the personal information of consumers under 16 years of age; the Service is limited to users 18 and older.

Your California rights: you have the right to know what personal information we collect, use, and disclose; to request deletion; to request correction; to receive a portable copy; to opt out of sale or sharing, which you can exercise by sending a Global Privacy Control signal from your browser, adjusting your cookie controls, or contacting us at tv@realgames.ai; to limit use of sensitive personal information (we do not use sensitive personal information for purposes requiring a limit right); and to non-discrimination. To exercise these rights, contact tv@realgames.ai or use your account settings. We will verify your request using your account email and respond within the timeframes required by law.

10. European Economic Area and United Kingdom (GDPR and UK GDPR)

If you are in the EEA or the UK, Real Games, Inc. is the controller of your personal data. You have the right to access, rectify, erase, restrict, and port your personal data, to object to processing based on legitimate interests, and to withdraw consent at any time where processing is based on consent. You also have the right to lodge a complaint with your local supervisory authority or, in the UK, the Information Commissioner's Office.

11. Canada (PIPEDA)

If you are in Canada, we handle your personal information in accordance with the Personal Information Protection and Electronic Documents Act and applicable provincial privacy laws. You may request access to or correction of your personal information, and you may withdraw consent subject to legal and contractual restrictions, by contacting tv@realgames.ai. You may also contact the Office of the Privacy Commissioner of Canada.

12. Children's Privacy

The Service is intended for users who are 18 years of age or older. The Service is not directed to children or minors, and we do not knowingly collect personal information from anyone under 18.

If we learn that we have collected personal information from a person under 18, we may suspend or terminate the account and take reasonable steps to delete the information, unless we are legally required to retain it.

13. Security and Active Monitoring

We use reasonable administrative, technical, and organizational measures designed to protect information, including access controls, authentication systems, CDN security rules, App Check enforcement, rate limiting, signed delivery tokens, and automated abuse detection. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please keep your account credentials confidential and do not share them with others.

We actively log and analyze access to the Service to enforce our Terms of Service, detect unauthorized use, and protect our content and infrastructure. Access logs, streaming request patterns, and session data may be retained and used in connection with legal proceedings, law enforcement referrals, or cooperation with third-party rights holders. See our Terms of Service for details on enforcement actions we may take.

14. International Transfers

We are based in the United States, and we process and store information in the United States and other countries through our cloud infrastructure providers. If you use the Service from outside the United States, you understand that your information will be transferred to and processed in the United States and other countries that may have different data protection rules than your own.

Where required for transfers of personal data from the EEA, the UK, or Switzerland, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum with our service providers.

15. Language and Changes to This Policy

This Privacy Policy is drafted in English. Translated versions may be provided for convenience only. To the extent permitted by applicable law, the English version of this Privacy Policy controls if there is a conflict with a translation.

We may update this Privacy Policy from time to time. If we make material changes, we will provide reasonable notice, such as posting the updated Policy with a new effective date. Your continued use of the Service after changes take effect means you accept the updated Policy.
